Die Teilnehmenden geben dem Veranstalter Victorinox im Rahmen des Wettbewerbs ihren Vornamen, Nachnamen, ihr Land und ihre E-Mail-Adresse bekannt und bestätigen, dass sie über 18 Jahre alt sind ("Teilnahmedaten"). Die Teilnahmedaten werden ausschliesslich zum Zwecke der Durchführung des Wettbewerbs erhoben, verarbeitet und genutzt. Den gewinnenden Personen sendet Victorinox eine Benachrichtigung und einen Gutschein-Code per E-Mail zu. Im Rahmen des Wettbewerbs laden die Teilnehmenden vor dem Hintergrund des potenziellen Gewinns ein Foto hoch. Die Fotos werden zum Zwecke der Durchführung des Wettbewerbs erhoben, verarbeitet und genutzt (inkl. Kommunikation und Veröffentlichung der drei Sieger-Fotos auf Social-Media und bei Eignung hierzu im Newsletter). Die drei Sieger-Fotos können darüber hinaus vom Veranstalter (oder von verbundenen Unternehmen des Veranstalters) nach eigenem freiem Ermessen, auch auf Webseiten, in Werbeanzeigen oder zu sonstigen Werbezwecken zugunsten von Victorinox kommerziell genutzt und veröffentlicht werden. Die übrigen Fotos werden nach Auswahl der Sieger-Fotos und nach erfolgreicher Zustellung der Preise oder deren Verfall nach Ziffer 12 der Teilnahmebedingungen gelöscht.
Um am Wettbewerb teilzunehmen und den Preis empfangen zu können, ist es erforderlich, dass die Teilnehmenden dem Veranstalter vorgenannten Teilnahmedaten angeben und die Fotos hochladen. Die im Rahmen der Teilnahme/Preisvergabe erhobenen Teilnahmedaten werden gemäss den Bestimmungen der anwendbaren Datenschutzgesetzgebung vertraulich behandelt und nach Beendigung des Wettbewerbs gelöscht, sofern die Daten nicht aus steuerlichen oder buchhaltungsrechtlichen Gründen aufbewahrt werden müssen.
Rechtsgrundlage für die Verarbeitung der Teilnahmedaten sowie der Fotos – soweit es sich dabei um personenbezogene Daten handelt – nach Anmeldung zum Wettbewerb ist die Durchführung eines Gewinnspielvertrags (Art. 6 Abs. 1 S. 1 lit. b DSGVO). Als Dienstleister, die im Auftrag und auf Weisung des Veranstalters die Gewinnspieldaten des Wettbewerbs verarbeiten, werden JUNE und Salesforce eingesetzt, mit denen Victorinox jeweils einen Auftragsverarbeitungsvertrag abgeschlossen hat. Etwaige US-Drittstaatenübermittlungen stützt Salesforce auf das US Privacy Framework als Angemessenheitsbeschluss. Die Sieger-Fotos werden an Social-Media Anbieter sowie ggf. an Newsletter-Abonnenten und Dienstleister von Victorinox im Rahmen von Werbemassnahmen weitergegeben.
Den Teilnehmenden stehen die gesetzlichen Auskunfts-, Berichtigungs-, Einschränkungs-, Löschungs- und Widerrufsrechte zu, die gegenüber dem Veranstalter geltend zu machen sind. Personenbezogene Daten werden nur so lange gespeichert, wie der mit ihrer Erhebung verbundene Zweck dies erfordert. Im Geltungsbereich der Europäischen Union (Datenschutzgrundverordnung [DSGVO] können die Teilnehmenden zudem ein Recht auf Datenübertragbarkeit sowie ein Beschwerderecht bei einer Datenschutzaufsichtsbehörde in Anspruch nehmen. Die Teilnehmenden können sich ausserdem am Ende des Wettbewerbs freiwillig für den Newsletter des Veranstalters anmelden, um über Neuigkeiten zu Produkten, Aktionen, Gewinnspielen und Veranstaltungen informiert zu werden. Das Abonnieren des Newsletters ist keine Voraussetzung für die Teilnahme am Wettbewerb. Wir verarbeiten die Teilnahmedaten auch für den Versand des Newsletters aufgrund der vorherigen Einwilligung der Teilnehmenden. Sofern die Teilnehmenden freiwillig ihr Geburtsdatum angegeben haben, verarbeiten wir daneben das Datum, um ihnen per E-Mail zum Geburtstag zu gratulieren und um unsere Newsletter zu personalisieren. Sofern die DSGVO anwendbar ist, ist Rechtsgrundlage Art. 6 Abs. 1 S. 1 lit. a DSGVO (bzw. in Österreich nach § 174 Abs. 3 TKG). Die Einwilligung erfolgt freiwillig und kann jederzeit mit Wirkung für die Zukunft widerrufen werden unter den obgenannten Kontaktdaten oder indem die Newsletter-empfangende Person sich mittels des im Newsletter enthaltenen Links abmeldet (z.B. durch Betätigung des «Unsubscribe»-Buttons in jedem Newsletter). Der Vorname, Nachname, die E-Mail-Adresse und das Land der Newsletter-empfangenden Person werden bis zur Abbestellung des Newsletters gespeichert. Das Geburtsdatum wird bei Widerruf der Einwilligung, spätestens bei Abbestellung des Newsletters, gelöscht.

Dans le cadre du Jeu, les participants communiquent à l’organisateur Victorinox leur prénom, leur nom, leur pays et leur adresse e-mail, et confirment être âgés de plus de 18 ans (les « Données de participation »). Les Données de participation sont collectées, traitées et utilisées exclusivement aux fins de l’organisation du Jeu. Victorinox adresse aux personnes gagnantes une notification et un code de bon d’achat par e-mail. Dans le cadre du Jeu, les participants téléchargent une photo dans la perspective d’un gain potentiel. Les photos sont collectées, traitées et utilisées aux fins de l’organisation du Jeu (y compris la communication et la publication des trois photos gagnantes sur les réseaux sociaux et, si elles s’y prêtent, dans la newsletter). Les trois photos gagnantes peuvent en outre être exploitées commercialement et publiées par l’organisateur (ou par des sociétés liées à l’organisateur), à sa libre appréciation, notamment sur des sites web, dans des annonces publicitaires ou à d’autres fins publicitaires au profit de Victorinox. Les autres photos sont supprimées après la sélection des photos gagnantes et après la remise effective des prix ou leur perte conformément au Paragraphe 12 des conditions de participation.
Pour pouvoir participer au Jeu et recevoir le prix, les participants doivent communiquer à l’organisateur les Données de participation susmentionnées et télécharger les photos. Les Données de participation collectées dans le cadre de la participation / de la remise des prix sont traitées de manière confidentielle, conformément aux dispositions de la législation applicable en matière de protection des données, et sont supprimées à l’issue du Jeu, sauf si les données doivent être conservées pour des raisons fiscales ou comptables.
La base juridique du traitement des Données de participation ainsi que des photos – dans la mesure où il s’agit de données à caractère personnel – après l’inscription au Jeu est l’exécution d’un contrat de jeu-concours (art. 6, par. 1, phrase 1, let. b du RGPD). JUNE et Salesforce interviennent en tant que prestataires traitant les données du Jeu pour le compte et selon les instructions de l’organisateur, chacun ayant conclu avec Victorinox un contrat de sous-traitance. Salesforce fonde d’éventuels transferts vers les États-Unis (pays tiers) sur le « US Privacy Framework » en tant que décision d’adéquation. Les photos gagnantes sont transmises aux fournisseurs de réseaux sociaux ainsi que, le cas échéant, aux abonnés de la newsletter et aux prestataires de Victorinox dans le cadre d’opérations publicitaires.

L’abonnement à la newsletter n’est pas une condition de participation au Jeu. Nous traitons également les Données de participation pour l’envoi de la newsletter sur la base du consentement préalable des participants. Si les participants ont consenti à indiquer leur date de naissance, nous traitons également cette information afin, d'une part, de leur envoyer des vœux d'anniversaire par e-mail et, d'autre part, de personnaliser nos newsletters. JUNE and Salesforce have each been appointed as a service provider to process the Competition data on behalf of and on the instructions of Victorinox, with whom Victorinox has data processing agreements. JUNE processes participant data for the purpose of operating and administering the Competition entry form on behalf of Victorinox. Where a participant opts in to the newsletter, participant data is transferred from JUNE to Salesforce via an existing system integration; Salesforce processes such data for the purpose of managing marketing communications (including the newsletter) as part of Victorinox's CRM infrastructure.
What personal data we collect:
As part of the Competition, participants upload photographs, with the prospect of winning vouchers redeemable on Victorinox's Website as an incentive.
Participants provide Victorinox with their first name, surname, country of residence and e-mail address (the “Entry Details”). The Entry Details (which for the avoidance of doubt, does not include date of birth or newsletter data) are collected, processed and used solely for the purpose of running the Competition.
Where a participant opts in to receive the newsletter, the participant may also voluntarily provide their date of birth as part of the newsletter subscription process. If provided, the date of birth will be processed by Victorinox solely for the purposes of sending personalised marketing communications in connection with the newsletter, including birthday e-mails, age-appropriate product recommendations and exclusive offers.
Purpose of processing and legal basis:
Participants' personal data is processed for the following purposes:
Competition administration: administering the participant's Entry to the Competition and, if the participant wins, delivering the Prize and publishing their first name and surname initials as required by section 12 of these Terms and Conditions (and to comply with Victorinox's obligations under the CAP Code to make information available indicating that a valid award took place). The legal basis for this processing is Article 6(1)(b) UK GDPR (performance of a contract). By entering the Competition, the participant enters into a contract with Victorinox, and processing the participant's personal data is necessary to perform that contract (i.e., to administer the participant's Entry and deliver any Prize).
Marketing use of participant photographs: participant photographs may be used by Victorinox and the Victorinox group in anonymised form (without any identifying element attributable to the participant or any other individual) in editorial texts, marketing materials, and advertisements, as described in section 13. Where photographs are used in fully anonymised form such that no individual can be identified, this falls outside the scope of UK GDPR. Where any element that could identify a participant is retained, the legal basis for such processing is Article 6(1)(b) UK GDPR (performance of a contract), as the provision of participant photographs for Victorinox's marketing use in exchange for the chance to win the Prizes is a core term of the Competition.
Newsletter: Participants may separately opt in to receive Victorinox's newsletter by ticking the optional newsletter subscription box on the entry form. Where a participant has also voluntarily provided their date of birth, that information will be processed alongside the newsletter data for the purposes described below. Subscribing to the newsletter is entirely voluntary and is not a prerequisite for participating in the Competition or winning the Prize. If the participant opts in to the newsletter, Victorinox will process the participant's e-mail address, first name, surname, country of residence and, where provided, date of birth for the purpose of sending marketing communications, including personalised communications such as birthday e-mails, age-appropriate product recommendations and exclusive offers. This data will be processed by Salesforce on behalf of Victorinox as part of Victorinox's CRM and marketing infrastructure. The legal basis for this processing is the participant's consent under Article 6(1)(a) UK GDPR. The participant's consent is given voluntarily and can be revoked at any time with future effect by:
- E-mailing internet.support@victorinox.com, or
- Clicking the 'Unsubscribe' link in any newsletter participant receives.
Data collection and security:
The participant's personal data is collected via an electronic form provided by JUNE who processes data in collaboration with Salesforce on Victorinox's behalf in accordance with UK GDPR. Victorinox, JUNE and Salesforce implement appropriate technical and organisational security measures to protect the participant's data, including encryption and secure data transmission.
The participant's personal data will be treated confidentially in accordance with UK data protection legislation and will not be passed on to third parties except as described in this section.
International transfers:
Participants' personal data will be transferred to:
Switzerland (Victorinox) – the organiser of the Competition
Germany (JUNE) – the data processor
US (Salesforce) – the data processor
Where winning photographs and related personal data are published on social media platforms, Winners' personal data will be transferred to Ireland (Meta Platforms Ireland Limited and X International Limited Company) and may subsequently be processed by members of the Meta and X groups, including in the US.
Transfers to Switzerland, Germany and Ireland (as EU member states) are made on the basis of the UK's adequacy decisions for Switzerland and the European Union respectively, which means participant's data receives equivalent protection to that provided under UK GDPR.
Transfers to the US (Salesforce and, where applicable, Meta and X group companies) are made on the basis of the UK Extension to the EU-US Data Privacy Framework (also known as the UK-US Data Bridge). Salesforce has certified that it adheres to the Data Privacy Framework Principles with respect to personal data transferred from the United Kingdom to the United States. The UK Government has recognised the UK Extension as providing an adequate level of protection for personal data transferred from the United Kingdom to certified US organisations. Retention period:
Personal data collected and processed in connection with this Competition will only be stored for as long as is necessary for the purpose for which it was collected, subject to the following:
Entry data (first name, surname, e-mail address, country of residence): stored for 90 days after the Competition ends (i.e. until 14 November 2026), after which it will be securely deleted.
Winner data (identity verification documents): retained until the Prizes have been successfully delivered and for such additional period as may be required by applicable law (including in respect of any applicable limitation period for claims), after which it will be securely deleted.
Pseudonymised marketing data (first name, surname, or initials used alongside a photograph in marketing materials, where consent has been given): retained for as long as the relevant marketing materials in which the photograph appears remain in active use, after which the data will be securely deleted or the photograph will be fully anonymised (without any identifying element attributable to the participant or any other individual).
Newsletter data (including, where provided, date of birth): retained until the participant withdraws their consent and unsubscribes, after which it will be securely deleted.
Notwithstanding the above, any personal data that must be retained under applicable law (including for tax, accounting, or legal proceedings purposes) will be retained for the period required by that law.
Where participant photographs are used in fully anonymised form (without any identifying element attributable to the participant or any other individual) for marketing purposes, no personal data is retained for that purpose.
